Home & Garden |
Home Improvement
This is just a hypothetical question; I saw something on TV and wondered if it was legal -

If you hire a babysitter/carer to come to your home and look after your child, but you suspect he/she is hurting your child, can you legally install surveillance in your home to monitor this, or do you have to inform them of what you’re doing?

Please can you include your country of residence with your answer?
In the UK, your employer has to inform you of any CCTV surveillance at your workplace, so I would assume someone’s home would be a babysitter’s workplace…? I think in this case the law should allow you to do it without telling the suspect.
Well we have strict smoking laws in the UK, when you’re forbidden from smoking in the workplace. It also means that home-workers can’t smoke in their own office at home, and landlords can’t smoke anywhere in their pub/restaurant building, even if they live on the property!

If you employ a carer to come to your home, it is technically their workplace, and the same laws would apply for them smoking. I would assume the same stands for CCTV.
Dr Jack, it’s not paranoid if you suspect your child is being abused by their carer. I would think it irresponsible if you turned a blind eye to it. And besides, you want evidence of the abuse in order to ensure they don’t hurt other kids…
Rabuff, of course you wouldn’t want your child at risk of abuse, but in the UK you have to have a reason to sack someone, and an inkling isn’t enough if they turn around and sue you for wrongful dismissal. If you only suspect something, and intend to charge them, you may need proof.

Firstly sorry if this question is a bit long but there is a lot to explain.
I’m 16 and im in TY in secondary school, and my school has around 850 students.
The story is, we had a week off at the end of October, on returning to school, cctv cameras had been put into every single bathroom in the school, boys and girls. the cameras are placed up on the walls, and are the type that are circular shaped covered in a dark glass, so there is no way of knowing what way it is pointing. We were told they were installed to prevent bullying and vandalism. i havnt heard of any bullying taking place and the vandalism is only minor. we were also told they are pointing towards the sinks, and not the cubicles, but they are in the boys bathrooms as well, and the rooms are very small surely they are not legal. i wouldnt mind but most of the toilets dont even have toilet seats, or soap. and from what im told in the boys bathrooms they are pointing at or near the urinals.

Apparently, it took our principal a long time to convince the board of management to be able to put them in, and the thing that annoys me the most is he didnt consult the student council, who represent all students. he just told them he was installing them and said to not tell anyone. Parents werent told either.

My question is what do you think of this? is there anything in Irish law to say he can do this?

Most people i know think it is a complete invasion of privacy, there is already cameras in every hallway, is that not enough?
The students are protesting tomorrow, and the protest was approved by the parents association.
yup i do go tho clane.
it isnt rough at all. the protest didnt go too well….
i wasnt there but considering only around 150 protested and all 70 TY’s were on work experience all week, you can imagine what sort of people were protesting…many people that protested only wanted a day off school….
its only a small amount of people that cause the trouble.
Apparently the data protection commissioner contacted the principal today and tlold him to remove the cameras…and Batt o Keefe said on tv3 this evening it was wrong.
The principal should have consulted parents/students more before installing cameras.

Approved for release by the TSA. Edited for content. I left the middle in for emphasis on the length of time involved. Video courtesy: Transportation Security Administration, the Port Authority and Continental Airlines, and Sen. Frank R. Lautenberg (D-NJ). Press Release of Senator Lautenberg Working With Law Enforcement, Lautenberg Releases Video of Newark Airport Security Breach Thursday, January 7, 2010 NEWARK, NJ – After calling for the release of surveillance footage of the January 3 security breach at Newark Liberty Airport in meetings with top security officials at the Transportation Security Administration, the Port Authority and Continental Airlines, Sen. Frank R. Lautenberg (D-NJ) today released video footage of the security breach. The video, approved for release by the TSA, is not considered Sensitive Security Information and law enforcement officials have determined that it will be useful in helping to advance the ongoing investigation. The release of this video will give law enforcement another tool to help find the person who breached the security gate at Newark Liberty Airport, stated Lautenberg. I encourage this individual or anyone with knowledge of his identity to immediately contact law enforcement. It is unacceptable that the Port Authority took so long to produce this tape, but now that it is public we have a better chance of getting to the bottom of this major security incident.
